21 25-4839 *Approving the Fourth Amendment to Lease Agreement between the City of Key West and Tropical Shell and Gifts, Inc. to extend the lease term for the property located at 1 Whitehead Street, Key West, Florida for an additional ten (10) year period beginning July 15, 2028 and ending July 14, 2038, pursuant to an option to renew granted under Resolution No.18-247 approving the Second Amendment to Lease; Authorizing the City Manager to execute the Fourth Amendment to Lease Renewal and any necessary related documents and/or budget transfers/amendments upon consent of the City Attorney.

    we need more time to think about this. i'm new to local politics and initially thought when referring to the 4th amendment it was citing it in a federal context i.e. the constitution, which gave me conspiratorial concerns. i have to be at work at 6:30am tomorrow i don't have the time to form an educated opinion on this, please give the public more time!

    I oppose signing this lease extension at this time. There needs to be more thought put into how the city and it's residents benefit from extending this lease hastily, in particular with regards to the additional shuttle aspect. We are in the midst of a semi crisis on the island regarding public transportation. We don't need to lock ourselves into a long term lease without understanding the ramifications of signing this lease. Particularly when it isn't even up for renewal for two more years. PLEASE POSTPONE THIS ITEM. It does not seem to benefit the city or our residents.

    I request this item be postponed for further review:
    1. A lease of $200,000 per year for the next ten years does not seem competitive in the current or future rental market. Additional research needs to be done on the rental value of this area.
    2. Public use as well as the Mallory Square renovation plan of the area need to be considered before a lease renewal is completed.

    More information should be provided to the public before an extension is agreed upon. There is plenty of time and no need to rush this through without full transparency.

    I request that this item be delayed. There are two years remaining on this lease and it seems rushed to add this to the consent agenda with limited public notice or discussion about the lease. Are the current City lease terms still competitive? How was that verified? Has the City audited the income to assure we are receiving the correct percent of sales? What impact will this have on potential TDC funding to bring back the Duval Loop? HTA is a great company that provides jobs and a good service to our visitors. Rushing this renewal through does not allow the transparency and open discussion many residents are hoping to see and only increases a perception of favoritism. Thank you.
