Approving the attached "Temporary Use Agreement Addendum BOT #440769265" between the City of Key West ("City") and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida ("Board") for Mallory submerged lands adjacent to Mallory T-Pier.
The proposed TUA infringes on the private property rights of an adjacent landowner and is connected with the City's proposal to build a larger cruise ship pier at Mallory. I understand this landowner has notified the City and FDEP that it does not consent. I am troubled by the apparent double standard. When attempts were made to reduce cruise ship size at Pier B, we were told the private property rights were “inviolable.” When the purpose is to build a bigger cruise ship pier at Mallory, will the City step over private property rights to do so?
